NO ATTORNEY-CLIENT RELATIONSHIP

All Rise Solutions is not a law firm, nor does it provide attorney services. As such, ACCESSING THE COMPANY’S SITE DOES NOT CREATE AN ATTORNEY-CLIENT RELATIONSHIP BETWEEN YOU AND ALL RISE SOLUTIONS OR ANY OF ITS AFFILIATED ENTITIES. Should you decide to access and pay for any of All Rise Solution’s premium or professional coaching services, please understand that our services are not suitable for everyone or every case. We make no guarantees regarding the outcome of ANY legal case.

ARS does not perform a conflicts check for anyone accessing the materials on this website. Anyone can access any of the articles, videos, webinars and other content on or affiliated with this website.  By using the Site you understand that both you and your spouse, as well as your spouse’s lawyer and others hired by your spouse, may all be accessing identical materials, and you acknowledge and agree that this does not run afoul of the Rules of Professional Conduct in any state.

All intellectual property rights to the materials are owned by All Rise Solutions. No materials may be sold, exploited for a commercial purpose, duplicated, shown in public, edited, or otherwise modified without the express written consent of All Rise Solutions

.If at any point we determine for any reason that we cannot continue to provide access to the materials currently available, we may remove access to such materials, and no recourse shall be available to any member of the public. These materials are provided as a public service by All Rise Solutions at its cost, and All Rise Solutions has no obligation to provide or continue to provide these materials.

RESPONSIBILITIES

In order to access some features of the Site, you must register on the Site. At registration, All Rise Solutions collects certain personal information about you.  Because the protection of your personal information is important to us, we will only use information we obtain about you in accordance with All Rise Solutions’s Privacy Policy.  You agree that you will: (a) provide true, accurate, current and complete information when prompted (e.g., at registration); and (b) maintain and update such information so that it is true, accurate, current, and complete at all times.  You are responsible for obtaining and maintaining any equipment and services (e.g., mobile phone and wireless service) needed in order to access and use the Site and for paying all related charges.

As part of the set-up and registration process, you may be asked to select a username and password.  ARS may refuse to grant you a username or revoke your username for any reason in its sole discretion, including in the event that we determine that such username impersonates someone else, is illegal, vulgar or otherwise offensive, or is protected by trademark or other proprietary rights law, or otherwise may cause confusion.  You will be responsible for the confidentiality and use of your username and password and agree not to transfer or resell your use of or access to any third party. YOU ARE ENTIRELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR USERNAME AND PASSWORD AND FOR ANY AND ALL ACTIVITIES THAT ARE CONDUCTED THROUGH YOUR ACCOUNT.  ALL RISE SOLUTIONS WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO ADEQUATELY SAFEGUARD YOUR PASSWORD OR FOR ANY ACTIONS OCCURRING UNDER YOUR PASSWORD.

ARS provides the following to its Users:

A Password Protected Program Area: All Rise Solutions shall maintain a Program Area that may include video, audio and written lessons, templates, worksheets, checklists, slide decks and other training and support information. You shall have access to this Program Area for as long as the Program Area exists. In the event ARS intends to close the Program Area, we shall provide ARS Users with a 30 day notice and the ability to download the core resources contained in the Program Area.

From time to time, All Rise Solutions will offer bonuses to individuals who sign up for an ARS Service. You shall be entitled to any bonuses offered to you at the time of your enrollment. Bonuses are not guaranteed to be available for the entire lifespan of a course, workshop, webinar or coaching service and varies depending on specific live and automated promotions offered by All Rise Solutions.

INTELLECTUAL PROPERTY RIGHTS

All material and content on this site (the “Content”), including, but not limited to the articles, information, page headings, graphics, images, button icons, and scripts, are the proprietary information of ARS. You may not copy, distribute, republish, upload, download, post, or transmit any of the Content in any way without the prior written consent of ARS, except that you may view and print out a copy of the Content solely for your personal use. FEES

In consideration of access to ARS, you agree to pay the required fees designated by All Rise Solutions upon registration for course, workshop, or coaching service.

If you opt for monthly payments, you will remain responsible for those payments unless you obtain a refund according to the specific ARS Refund Policy set forth below. You may not cancel or avoid these payments except through the Refund Policy. In the event that any payment is not made, the Company shall immediately suspend your access to the course, workshop, or coaching service.

METHODS OF PAYMENT

If You elect for the payment plan, You hereby authorize ARS to charge your credit card or debit card automatically according to the terms set forth in the Fees section above.

Regarding recurring payments and outstanding invoices: If all eligible payment methods we have on file for you are declined for payment of any required fee, you must provide a new eligible payment method promptly or your access to ARS will be removed.

If you do not request a refund within the terms specified below, you are required by law to complete the remaining payments of your payment plan and you will continue to have access to the course, workshop, or coaching service FOR WHICH YOU REGISTERED, and you authorize ARS (without notice to you, unless required by applicable law) to collect any and all outstanding receivables, using any eligible payment method we have on record for your account.

ARS REFUND POLICY RE:  ONLINE COURSES

If you’re on the fence about enrolling in All Rise Solutions’s Ultimate Divorce Document Checklist Course, ARS is committed to giving you access to the course, and we will stand behind our 7-day money back guarantee.  We will refund your money if 

• In the event you decide that your purchase was not the right decision, within 7 days of enrollment you must contact our support team at support@allrisesolutions.com to request your refund.  This refund request must be made by the 7th day from the date of purchase at 11:59 EST. 

Upon determining that you are entitled to a refund pursuant to this policy, All Rise Solutions will promptly issue an instruction to its payment processor to issue the refund. ARS does not control its payment processor and will not be able to expedite any refunds. Fees paid for completed Coaching Sessions are non-refundable.

If you receive a refund of any purchase through this money-back guarantee, such action will result in immediate termination of any and all licenses granted to you for use of the material provided to you under this Agreement and the ARS’s Terms of Use. You shall immediately cease using the material and shall destroy all copies of the information provided to you, including without limitation: video recordings, audio recordings, forms, template documents, slide shows, membership areas, social media groups limited to paying members, and other resources.

All refunds are discretionary as determined by All Rise Solutions, LLC. To further clarify, we will not provide refunds after the 7th day from your date of purchase.

ARS REFUND POLICY RE:  LIVE WORKSHOPS

ARS wants you to be satisfied with your Live Workshop purchase, but it’s also important that you give your best effort to attend the Live Workshop.  Our refund is governed by the following terms.

Cancellations must be sought within ARS’s following time frame:  ARS subscribes to a “48 Hour Rule,” i.e., no less than 48 working hours prior to the scheduled Live Workshop date.  A full refund will be given minus a small fee of 10% of the Live Workshop price, if you have requested a refund within 48 hours of the start of the Live Workshop.

Substitution Option:

All Rise Solutions provides you with an option of “Substitution.” You can either Substitute another Live Workshop (the exact same topic) or Substitute a different upcoming Live Workshop of a similar topic. If you Substitute one Live Workshop for another you will avoid the 10% processing fee.

Substitution/Cancellation WILL NOT be accepted in the following cases:

1. If you as a registered user and DID attend the Live Workshop AND failed to inform us of your intended desire to cancel your attendance prior to the expiration of the 48 Hour Rule.
2. If you as a user/registered participant DID NOT attend the Live Workshop AND failed to inform us of your intended desire to cancel your attendance prior to the expiration of the 48 Hour Rule.
3. If the registered user DID NOT receive the Workshop registration instructions due to email bounce/firewall protection. In the case where you failed to receive instructions or login credentials due to email bounce or firewall protection, it is your responsibility to contact ARS support at the following email address:  support@allrisesolutions.com to obtain your instructions and login credentials.  You must provide proof of any email sent to the above email address informing ARS that you did not receive the necessary registration or login email

Upon determining that you are entitled to a refund pursuant to this policy, the same procedures and policies set forth in the above section, i.e., ARS Refunds Policy RE:  Courses. 

YOUR CONTENT

“Your Content” shall mean any text, images, video, audio, or other material you choose to display on this Website. By displaying Your Content, you grant All Rise Solutions, LLC an irrevocable, non-exclusive, worldwide, license to use, reproduce, adapt, publish, translate and distribute Your Content in any and all media forever.

Your Content must be your own and must not be invading any third-party’s rights.  All Rise Solutions, LLC reserves the right to remove any of Your Content from this Website at any time, for any reason, in its sole discretion, without notice.

EMAIL RIGHTS AND RESPONSIBILITIES

If you sign up to receive any material on this Site you are agreeing that ARS may send emails to the email address you used to sign-up and/or any other email address you may request to be used. You may unsubscribe from ARS’s email list at any time. If you want to receive any material on this website without submitting your name and email address, please contact ARS directly and make an appropriate request.

CONFIDENTIALITY

ARS respects the privacy of its Users and will not disclose any information you provide except as set forth in these Terms & Conditions. As a condition of being a User, you hereby agree to respect the privacy of other Users and to respect the Company’s confidential information.

Specifically, you shall not share any information provided by other Users outside of the bounds of the Site unless you receive express written permission from such other Users to share the information. Similarly, the content of this Site contains the ARS’s proprietary methods, processes, forms, templates, and other information. 

NO TRANSFER OF INTELLECTUAL PROPERTY

All content included as part of ARS’s service such as text, graphics, logos, images, as well as the compilation thereof, and any software is the property of ARS or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights.

The Company name, the Company logo, the Company slogan, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs and slogans are the trademarks of their respective owners.

Your participation as a User does not result in a transfer of any intellectual property to You, and, as a condition of participation as a User, You agree to observe and abide by all copyright and other intellectual property protection.

You are granted a single-use, non-exclusive, non-transferable, revocable license to access and use the Site Content and resources. You hereby agree that You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site.

The Company content is not for resale. Your participation as a User does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. SEVERABILITY/WAIVER

If any term or provision of this Agreement is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction.

ASSIGNMENT

Users may not assign this Agreement without express written consent of Company.

MODIFICATION

Company may modify terms of this agreement at any time. All modifications shall be posted on All Rise Solutions, LLC’s website and Users shall be notified.

TERMINATION

The Company reserves the right, in its sole discretion, to terminate your access to the ARS content and the related services or any portion thereof at any time, if You become disruptive to the Company or other Users, if You fail to follow ARS guidelines, or if You otherwise violate this Agreement. You shall not be entitled to a refund of any portion of the fees and shall not be excused from any remaining payments under a payment plan in the event of such termination.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and third parties for any losses, costs, liabilities, and expenses (including reasonable attorneys’ fees) relating to or arising out of your use of or inability to use the Program and related services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. The Company reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with the Company in asserting any available defenses.

RESOLUTION OF DISPUTES

You hereby expressly waive any and all claims you may have, now or in the future, arising out of or relating to the Program. To the extent that you attempt to assert any such claim, you hereby expressly agree to present such claim only in the state or federal courts that are geographically nearest to Vallejo, CA.

EQUITABLE RELIEF

In the event that a dispute arises between the Parties for which monetary relief is inadequate and where a Party may suffer irreparable harm in the absence of an appropriate remedy, the injured Party may apply to any court of competent jurisdiction for equitable relief, including without limitation a temporary restraining order or injunction.
